The reconstruction of bacterial evolutionary relationships has proven to be a daunting task because variable mutation rates and horizontal gene transfer (HGT) among species can cause grave incongruities between phylogenetic trees based on single genes. Recently, a highly robust phylogenetic tree was constructed for 13 γ‐proteobacteria using the combined alignments of 205 conserved orthologous proteins.1 Only two proteins had incongruent tree topologies, which were attributed to HGT between Pseudomonas species and Vibrio cholerae or enterics. While the evolutionary relationships among these (...) species appears to be resolved, further analysis suggests that HGT events with other bacterial partners likely occurred; this alters the implicit assumption of γ‐proteobacteria monophyly. Thus, any thorough reconstruction of bacterial evolution must not only choose a suitable set of molecular markers but also strive to reduce potential bias in the selection of species. Legal decision-support systems have the potential to improve access to justice, administrative efficiency, and judicial consistency, but broad adoption of such systems is contingent on development of technologies with low knowledge-engineering, validation, and maintenance costs. This paper describes two approaches to an important form of legal decision support—explainable outcome prediction—that obviate both annotation of an entire decision corpus and manual processing of new cases. The first approach, which uses an attention network for prediction and attention weights to highlight salient case (...) text, was shown to be capable of predicting decisions, but attention-weight-based text highlighting did not demonstrably improve human decision speed or accuracy in an evaluation with 61 human subjects. The second approach, termed semi-supervised case annotation for legal explanations, exploits structural and semantic regularities in case corpora to identify textual patterns that have both predictable relationships to case decisions and explanatory value. Within the academic community there has been debate around whether business ethics should be taught as a stand-alone course or rather integrated across the business curriculum. A different tack is taken here as we head in the direction of integrating business ethics beyond the traditional bounds of the business curriculum and into theatre arts. The collaboration outlined herein was established when an inter-College alliance was formed to create the devised play Cheat, a mainstage theatre production for Western Washington University (WWU), (...) in which theatre became the ground and moral theory from business ethics became the figure. Refiguring Critical Theory offers some thoughts about the nature of democracy and the possibilities of individual and collective self-determination. The text traces theories of the relationship between being and consciousness from Marx through Lukacs and the Frankfurt School to Habermas' recent work The Theory of Communicative Action.

The relationship between being and consciousness has been characterised as one of alienation , reification , instrumentalization , and 'one dimensionalization' . More recently Jurgen Habermas has described the 'colonization of the lifeworld'. Each of these theorists argues that social and political philosophy has two primary tasks. First, a political philosophy should construct a model of how we might best structure our social and political situation so as to maximize freedom and self-determination. Second, a political philosophy should provide an analysis (...) of presently existing conditions. The gap between the model and the actually existing reality provides the space for social and political criticism, as well as social and political struggle. In his account of 'the colonization of the lifeworld', Habermas attempts to explain the relation between being and consciousness in terms of his theory of communicative action and to locate possible points of social and political crisis in advanced capitalist society. ;In this dissertation I trace theories of the relationship between being and consciousness from Marx through Lukacs and the Frankfurt School to Habermas' recent work The Theory of Communicative Action. I argue that in terms of his stated goal of providing a critical social theory with practical intent Habermas has been only partially successful. I present an account of Habermas' theory and claim it is potentially more politically efficacious than post-structuralist theories, though only if his theory is attentive to the concerns of those same post-structuralist theories. After arguing that at a certain level of abstraction Habermas is right in his account of our present situation, I conclude that he falls short of his goal in so far as his theory fails to take adequate account of many actually existing struggles for political self-determination, and many hypotheses for alternative social organization which do not agree with his assumptions about validity and consensus. Despite historic efforts to enact the Patient Protection and Affordable Care Act in 2010, national health reform is threatened by multiple legal challenges grounded in constitutional law. Premier among these claims is the premise that PPACA’s “individual mandate” is constitutionally infirm. Attorneys General in Virginia and Florida allege that Congress’ interstate commerce powers do not authorize federal imposition of the individual mandate because Congress lacks the power to regulate commercial “inactivity.” Stated simply, Congress cannot regulate individuals who choose not to (...) obtain health insurance because they are not engaged in a commercial venture. Several courts initially considering this argument have rejected it, but two federal district courts in Virginia and Florida have concurred, leading to numerous appeals and the near promise of United States Supreme Court review. Boltanski reflects on the connections between his investigations of grammars of justifications and his later work with Eve Chiapello on the historical transition to a new spirit of capitalism. Hierarchy has been a central concern of work on the modern political imaginary. The need to elucidate hierarchy’s deeper sources and its legitimations were some of the motivations behind Cornelius Castoriadis’ development of the notion of the imaginary. The work of Claude Lefort on the political imaginary similarly commences from a critical analysis of the hierarchical form of bureaucracy and its place in the constitution of totalitarian political regimes. In a different vein, Charles Taylor’s conception of the imaginary details a (...) long-term process of the erosion of preceding forms of hierarchy and their justifications. In the contemporary period, the opposition to hierarchy has penetrated organisations and institutions that had previously been shaped by it, like the family, the capitalist firm, the school, and the political movement. Despite the potentials that these initiatives suggest of a change in the political imaginary, it will be argued that forms of hierarchy have, to varying degrees, been reconstituted and that the problem of hierarchy appears in new ideological forms, both with respect to institutionalised power and the legitimating justifications for how things are organised. The critique of hierarchy was once associated with the radical democratic imaginary, however, there have recently been perverse mobilisations. (shrink)

This introduction to a special issue of Thesis Eleven devoted to the work of Luc Boltanski overviews the various contributions to the issue, including the interview it contains with Luc Boltanski that was conducted by Craig Browne. Boltanski is described as challenging formulaic approaches in sociology and as developing instead novel theoretical insights and an innovative pragmatist methodology. It is suggested that these innovations are complemented by Boltanski’s substantial investigations into empirical developments. Links are drawn between the themes of (...) Boltanski’s work, especially on the new spirit of capitalism, and Peter Murphy’s book The Collective Imagination, which is the subject of a review essay article by Craig Browne. This paper suggests that pragmatism makes a distinctive contribution to the theory and practice of radical democracy. It investigates the relation ship between the renewal of interest in pragmatism and the recent attempts to develop radical democratic alternatives to political liberalism. With particular reference to the contemporary critical social theory of Habermas and Honneth, the paper outlines key dimensions of the civic republican, deliberative democratic and reflexive cooperative reconstructions of John Dewey's conception of democracy. These reconstructions are shown to have (...) explicated important pragmatist insights concerning public participation in civic associations, the discursive practices of deliberation, and the cooperative organization of the division of labour. However, it is argued that each of these reconstructions pre suppose some facet of the additional pragmatist understanding of the creativity of action and that the most distinctive contributions of pragmatism to radical democratic theory and practice derive from a notion of democracy as instituted and emergent meaning. Charles Taylor’s conception of the relationship between democracy and social creativity developed through a critical synthesis of various traditions, including the Romantic Movement and liberal political philosophy. However, it is argued that Taylor’s understanding of the implications of religion and revolution significantly differentiates his standpoint from that of pragmatism and theories of democratic creativity. Taylor’s defence of religious transcendence is shown to give rise to tensions with the latter perspective. The theorists of democratic creativity suggest that democracy originates in the (...) rupturing of religious significations and their closure of meaning. Taylor essentially inverts these arguments and perceives that the loss of transcendence may lead to a closed world structure. Taylor claims that the dilemmas of the modern immanent frame were prefigured in the French Revolution’s inability to generate an institutional form consistent with its understanding of democracy and that social creativity should be qualified in light of this historical experience. Immanent critique has been a defining feature of the programme of critical social theory. It is a methodology that underpins theoretical diagnoses of contemporary society, based on its linking normative and empirical modes of analysis. Immanent critique distinctively seeks to discern emancipatory or democratizing tendencies. However, the viability of immanent critique is currently in question. Habermas argued that it was necessary to revise the normative foundations of critical social theory, late-capitalist developments tended to undermine immanent critique. Although there is a (...) need for critical social theory to incorporate aspects of alternative interpretations of the contemporary period, the logics of influential theoretical perspectives on the present, especially postmodernism, the risk society and globalization, will be shown to be inconsistent with some of immanent critique's presuppositions. The synthetic aspirations of critical social theory nevertheless persist in recent attempts to reconcile positive liberty and social justice. (shrink)

We approach the physics of \emph{minimal coupling} in general relativity, demonstrating that in certain circumstances this leads to violations of the \emph{strong equivalence principle}, which states that, in general relativity, the dynamical laws of special relativity can be recovered at a point. We then assess the consequences of this result for the \emph{dynamical perspective on relativity}, finding that potential difficulties presented by such apparent violations of the strong equivalence principle can be overcome. Next, we draw upon our discussion of the (...) dynamical perspective in order to make explicit two `miracles' in the foundations of relativity theory. We close by arguing that the above results afford us insights into the nature of special relativity, and its relation to general relativity. (shrink)

This paper assesses the extent to which the category of hope assists in preserving and redefining the vestiges of utopian thought in critical social theory. Hope has never had a systematic position among the categories of critical social theory, although it has sometimes acquired considerable prominence. It will be argued that the current philosophical and everyday interest in social hope can be traced to the limited capacity of liberal conceptions of freedom to articulate a vision of social transformation apposite to (...) contemporary suffering and indignity. The background to these experiences is the structural changes associated with the injustices of globalisation, the mobilisation of the capitalist imaginary and the uncertainties of the risk society. The category of hope could assist in sustaining the utopianism of critical theory through conjoining normative principles with a temporal orientation. Yet, the paradoxes of the current phase of capitalist modernisation have further denuded notions of progress. Since the theological background to the category of hope constitutes a major limitation, the utopian orientation of critique is clarified in relation to the antinomies of the turn to social hope and the potential of Habermas' discourse theory of democracy, law and morality. Despite Castoriadis' profound critique of the category of hope, its present usage in social analyses will be seen to have affinities with Honneth's conception of the struggle for recognition. Despite the lack of invariance problem (the many‐to‐many mapping between acoustics and percepts), human listeners experience phonetic constancy and typically perceive what a speaker intends. Most models of human speech recognition (HSR) have side‐stepped this problem, working with abstract, idealized inputs and deferring the challenge of working with real speech. In contrast, carefully engineered deep learning networks allow robust, real‐world automatic speech recognition (ASR). However, the complexities of deep learning architectures and training regimens make it difficult to use them to (...) provide direct insights into mechanisms that may support HSR. In this brief article, we report preliminary results from a two‐layer network that borrows one element from ASR, long short‐term memory nodes, which provide dynamic memory for a range of temporal spans. This allows the model to learn to map real speech from multiple talkers to semantic targets with high accuracy, with human‐like timecourse of lexical access and phonological competition. Internal representations emerge that resemble phonetically organized responses in human superior temporal gyrus, suggesting that the model develops a distributed phonological code despite no explicit training on phonetic or phonemic targets. The ability to work with real speech is a major advance for cognitive models of HSR. (shrink)

This study addresses a central theme in current philosophy: Platonism vs Naturalism and provides accounts of both approaches to mathematics, crucially discussing Quine, Maddy, Kitcher, Lakoff, Colyvan, and many others. Beginning with accounts of both approaches, Brown defends Platonism by arguing that only a Platonistic approach can account for concept acquisition in a number of special cases in the sciences. He also argues for a particular view of applied mathematics, a view that supports Platonism against Naturalist alternatives. Not only (...) does this engaging book present the Platonist-Naturalist debate over mathematics in a comprehensive fashion, but it also sheds considerable light on non-mathematical aspects of a dispute that is central to contemporary philosophy. Thought experiments have a long and illustrious history. But in spite of their acknowledged importance, there has until recently been remarkably little said about them. How do they work? Why do they work? What are the different ways in which they work? And above all: How is it possible that just by thinking we can learn something new about the world? This paper surveys some of the recent approaches, including my own , and discusses their various prospects. Chief among the (...) alternatives is John Norton′s “argument” view. The paper ends by drawing attention to some of the outstanding problems in thought experiments. These are some of the issues that will likely be the focus of attention and research in the future. Examples of classic thought experiments are presented and some morals drawn. The views of my fellow symposiasts, Tamar Gendler, John Norton, and James McAllister, are evaluated. An account of thought experiments along a priori and Platonistic lines is given. I also cite the related example of proving theorems in mathematics with pictures and diagrams. To illustrate the power of these methods, a possible refutation of the continuum hypothesis using a thought experiment is sketched.

Pp. x + 252. $24.95, hardcover.Thomas Rickert had a falling-out with his brother, and this distresses him so much that his disrupted relation is described as “traumatic.” Rickert reports that while (...) listening to a portable CD player during a run on an unexpectedly warm winter day, a song by the now defunct jazz/rock band Morphine reminded him of a happy time at a pool hall with his brother (24). Mediated—or better, medicated—by music, the homological happiness of running in the sun and a positive past memory also resurfaced a painful relational rupture, the reason of which Rickert omits to underscore that mysterious, “little detail or object” of the Real that marks his singular finitude as a writing subject (216 n. 11). We’ll want to come back to this curiously deliberate omission, but for the present we note Rickert is not simply an undead author but a human being with relations and feelings. He is not just a gifted scholar or a bundle of reflections, but a nexus of body and movement and words and affect. If there is anything that Rickert’s study can be said to work through with brilliance, humor, and grace, it is the reality of complex personhood.Rickert’s brotherly confession comes in Chapter 1 as a way to introduce a psychoanalytic understanding of subjectivity, and more specifically, to help illustrate how trauma works itself out as an afterwardness or “belatedness” ( Nachträglichkeit ): traumatic events from the past are not reckoned with or worked-through until some coincidence or reminder, such as a similar [End Page 183] sensory experience, reintroduces the event in doubled re-presentation (18–27). This implies the “subject” (a paradigm person) is a kind of timedelay, a self-conscious temporal moving that becomes this way through re-presentation. The rhetorical subject is analogously a retrojected reckoning with events past (not all traumatic) that Rickert identifies as a scene of writing, a locus that has important implications for rhetorical studies in general and writing pedagogy in particular. Rickert’s logic is as follows: if we agree that the subject is a belated one in the psychoanalytic sense, then how we teach rhetoric needs to change. Rickert opens the book with the observation that his students are producing excellent cultural critiques but that such critiques do not lead the students to change their actions (1–7), perhaps evidence enough that something is not quite right in a classroom grounded by “cultural studies pedagogy” and ideology critique—or at the very least, proof that something has changed. The opening gambit is simply that a “postpedagogy” premised on an understanding of rhetorical subjectivity as belatedness is better than a status quo rooted in the rational subject of the Enlightenment.Mostly through a Žižek-filtered, Lacanian lens, Acts of Enjoyment then undertakes a retake of the rhetorical field, frequently scanning from the traumatic ontology of the rhetorical subject to that domain of knowledge that we hold dear, the subject of rhetoric. In Chapter 2, the (primal) scene thus shifts from the slo-mo subject to rhetorical studies, initially through a reassessment of Kinneavy’s “communications triangle,” but ultimately in response to the shock treatment of poststructuralism. The initial theoretical traumas introduced by Victor Vitanza, Diane Davis, Sharon Crowley, and others discussed in Chapter 1 are threaded into an account of “poststructural” redress in Chapter 2: as is true of all forms of trauma, the initial poststructural jolt delivered to the concept of subjectivity was deadened; poststructural theory was eventually used to “shore up rather than challenge Kinneavy’s triangle” (37). To truly work-through our traumatized subject in both senses, we need a second trauma: Lacanian psychoanalysis. Presumably, “poststructuralist thought” is to be opposed because it has no account of the subject (21–24); “Lacan,” after all, “is not a poststructuralist” (48). This study examines the presence and roles of female directors of U.S. Fortune 500 firms, focusing on committee assignments and director background. Prior work from almost two decades ago concludes that there is a systematic bias against females in assignment to top board committees. Examining a recent data set with a logistic regression model that controls for director and firm characteristics, director resource-dependence roles and interaction between director gender and director characteristics, we find that female directors are less likely than (...) male directors to sit on executive committees and more likely than male directors to sit on public affairs committees. There is little if any evidence of systematic gender bias in director assignment to other board committees. We find some evidence that boards evaluate resource dependence differently for women than men. (shrink)

The Collective Imagination explicates the media of social creativity and explains how the imagination has shaped historically significant social institutions. It focuses on the media of wit, paradox, and metaphor, and develops a distinctive and original interpretation of the imagination’s appositional quality. Murphy’s conception of the collective imagination is compared with that of Cornelius Castoriadis. The discussion suggests that Murphy’s claims are likely to be disputed, particularly because they diverge from the common equation of contemporary creativity with social progress. Murphy (...) draws attention to a kind of conservative disposition that is necessary for imagination to have substantial social efficacy. Murphy claims that the creativity of the collective imagination has to a large extent been eclipsed by fantasy and kitsch. The deleterious effects of fantasy’s denial of reality are explored in relation to four domains of collective creativity: art, society, economy and politics.
